The Urth Caffe in Laguna Beach, California, seemed to be on the fast track toward going out of business.
Facing a lawsuit from Muslims claiming discrimination, the restaurant refused to lie down and instead took an aggressive approach by filing a countersuit that may open doors to expose future fraudulent claims of discrimination.
Basically, the argument went something like this: The Muslims claiming discrimination aren’t looking for compliance of law but rather abusing the process of law to achieve personal fame or fortune.
“This lawsuit claiming religious discrimination is a fraud and a hoax on the courts and the media,” said Urth Caffe’s attorney, David Yershalmi, in a statement to the online organization LawNewz.
“It is nothing short of an abuse of process to extort public apologies and other accommodations from my client, Urth Caffe,” he added.
The restaurant claimed that the lawsuit has an “underlying agenda” that has nothing to do with justice, and because of this, the suit should be dismissed. Lending even more credibility to this specific case was the fact that the restaurant’s co-owner was a Muslim.
If accepted by the court, the argument that some discrimination cases could be considered abuse of process could turn future incidents into public relations nightmares for those who file them.
With more and more discrimination “trolls” attempting to find fortune and fame by pretending to be humiliated by a private business that didn’t properly react to their specific lifestyle, the outcome of this case could be more significantly impactful than it might first appear.
The argument is similar to that used to call for the banning of red light cameras, saying that such cameras have nothing to do with safety or justice but everything to do with generating tax revenue.
