With Judge Neil Gorsuch’s Senate confirmation vote just a few days away, all eyes are on Senate Democrats to see if they will have the necessary numbers to successfully mount a filibuster against Gorsuch.
Right now, it appears they will. However, at least two Democrats so far have indicated they won’t support the filibuster, including West Virginia Democrat Joe Manchin, Breitbart reported.
“You get to Judge Gorsuch, you start looking at, basically, the qualities of the human being — his temperament, his educational attainment, how he’s viewed by his peers, how his rulings have been,” Manchin explained. “I could not find a reason why this man, this good man, Judge Gorsuch, should not at least be allowed to have an up or down vote.”
Manchin indicated that he will vote for cloture (the process to break a filibuster). Invoking cloture requires 60 votes, and as of right now the only other Democrat who will join all 52 Republicans in invoking cloture is North Dakota Democrat Sen. Heidi Heitkamp, The Hill reported.
“After doing my due diligence by meeting with Judge Gorsuch and reviewing his record and testimony before the Senate Judiciary Committee, I’ve decided to vote in favor of his confirmation,” Heitkamp explained.
Republicans need six other Democrats to break ranks with their party and join them in voting for cloture. As of Saturday morning, the path to cloture was increasingly narrow as more Democrats indicated they would support a filibuster.
Many may not personally want the filibuster to go forward, but they are bowing to pressure from Senate Minority Leader Chuck Schumer, who is determined to stop anything that [President Donald Trump wants to do.
Obviously, Manchin and Heitkamp are bold enough to defy party leadership and do the right thing. Both also happen to be up for re-election next year in states that Trump won handily.
Hopefully more of their colleagues will join them.
Politico noted that Republicans can always invoke the so-called “nuclear option” to change the Senate rules, but not all Republicans are firmly behind such a move.
Gorsuch is incredibly qualified for the Supreme Court. If Democrats would simply open their eyes and see the facts, instead of being blinded by their hatred for Trump, they would understand that filibustering this nominee will ultimately end up hurting them in the next election cycle — and possibly beyond.
