President Barack Obama is doing everything possible to disrupt President-elect Donald Trump’s agenda, according to CNN.
With the end of his term looming, he has killed the Muslim registry program, banned critical oil drilling, blocked states from requiring proof of citizenship when registering to vote, and threw every wrench he could find into our relations with Russia and Israel.
In his most ostentatious last-minute power grab yet, President Barack Obama has made a play to begin centralizing our elections. U.S. Homeland Security Secretary Jeh Johnson announced the move on Friday, according to the Associated Press.
The feds intend to designate the U.S. election system as “critical infrastructure,” meaning it would come under the same oversight as defense, leaving the door open for a federal takeover. Most of the other 16 critical infrastructures such as energy, communications and agriculture are already in the private sector.
Christy McCormick, a commissioner for the U.S. Election Assistance Commission, said the decision potentially gives significant authority to numerous federal agencies.
“This has not been thought out (and) the scope of what they’re speaking about is huge,” she said. She planned to ask Trump to review the decision.
Not that Obama cares, but it’s also unconstitutional.
“The Department of Homeland Security does not have the legal authority to interfere with states’ election systems without their permission,” University of California/Berkeley School of Law Professor John Yoo told CNSNews. “While the federal government has the general power to protect the nation’s cyber infrastructure, it cannot intrude into areas of state sovereignty without clear constitutional mandate.”
“There is no federal power to control or secure elections. Each state administers its own elections, restricted only by constitutional protections for voting rights,” agreed Illya Shapiro, senior fellow in constitutional studies at the Cato Institute.
The icing on the cake? Georgia’s election system was the victim of a failed hack by the DHS.
Secretary of State Brian Kemp said the unsuccessful attempt to breach the firewall of state computer systems occurred on Nov. 15 and was traced to DHS. Given that Kemp has been vocally opposed to federal election intervention since discussions began in August, it is curious that his state was targeted.
Perhaps Obama thinks no one is watching, or that we’re so distracted by his other shenanigans that this can slide by unnoticed. Local and state control over elections is a cornerstone of our democracy. Americans should be very concerned about this and must make their voices heard.
